FROM BUDAPEST TO HANOI: COMPARING THE COUNCIL OF EUROPE AND UNITED NATIONS CYBERCRIME CONVENTIONS

In this article available here, Kenneth Propp and DeBrae Kennedy-Mayo analyze the new and controversial United Nations Cybercrime Convention in comparison to the long-established Council of Europe Cybercrime Convention.  They identify the substantial commonalities of the two international instruments, as well as important differences, and examine criticisms of the UN Convention that have been voiced by technology companies and human rights groups.  The U.S. Government must decide whether to sign the UN Convention at a signing conference later this year.

Also included is a comprehensive side-by-side chart of provisions in the two Conventions, enabling readers to understand the similarities and differences in depth.
